Terms of Service

These Terms of Service ("Terms") govern access to and use of AfriSecSys (the "Service"), provided by Optinet Global Links ("Optinet", "we", "us"). By creating an account or using the Service, you agree to these Terms on behalf of yourself and the company you represent ("you", "your company").

1. The Service

AfriSecSys is a subscription-based, multi-tenant software platform for managing security company operations, including guard deployment, shift scheduling, attendance, human resources, payroll, client billing, incident reporting and related functions. Each customer's data is stored in a dedicated, isolated database schema, as described in our Security page.

2. Accounts and Access

Your company's administrator is responsible for creating and managing user accounts within your organization, including office staff and guard/supervisor accounts. You are responsible for keeping login credentials confidential and for all activity that occurs under accounts your company controls. Temporary or reset passwords must be changed before further access is granted — this is enforced automatically by the Service. Notify us promptly at any suspected unauthorized use of an account.

3. Free Trial and Subscription

New accounts may begin with a free trial of 30 days, with no payment card required to start. After the trial period, continued use of the Service requires an active paid subscription, billed on a per-active-guard basis at the rate shown on our Pricing page at the time of billing. Prices are subject to change with notice; changes apply from your next billing cycle, not retroactively.

If a subscription payment is not received, we may suspend access to the Service after reasonable notice. Suspension does not delete your data; continued non-payment beyond a reasonable period may result in termination as described in Section 8.

4. Acceptable Use

You agree not to: use the Service for any unlawful purpose; attempt to access another customer's data or bypass the isolation between tenant accounts; probe, scan or test the vulnerability of the Service without authorization; interfere with or disrupt the integrity or performance of the Service; or resell or sublicense access to the Service without our prior written agreement.

5. Your Data

You retain ownership of all data you or your company's users submit to the Service ("Customer Data"), including employee records, attendance, incident reports, client and billing information. We act as a processor of that data on your behalf and will not access it except to provide support, maintain the Service, comply with law, or as you direct. On termination of your account, you may request an export of your Customer Data within a reasonable period before it is deleted from our systems; see our Privacy Policy for how we handle personal data specifically.

6. Third-Party Services

Some features rely on third-party providers acting on your instruction — for example, M-Pesa payment processing via Safaricom's Daraja platform, and SMS delivery via TextSMS. Your use of these features is also subject to that provider's own terms, and we are not responsible for their availability, accuracy or performance.

7. Availability

We aim to keep the Service available and performant but do not guarantee uninterrupted access. Planned maintenance will be scheduled to minimize disruption where reasonably possible. The Service is provided without a formal Service Level Agreement (SLA) unless a separate written agreement between you and Optinet says otherwise.

8. Termination

You may stop using the Service and request account closure at any time by contacting us. We may suspend or terminate an account for material breach of these Terms (including non-payment) that isn't corrected within a reasonable period after notice. On termination, Customer Data is retained for a limited period to allow export, then deleted in the ordinary course, except where retention is required by law.

9. Limitation of Liability

To the fullest extent permitted by law, Optinet's total liability arising from or related to the Service is limited to the amount you paid for the Service in the twelve (12) months preceding the claim. Neither party is liable for indirect, incidental or consequential damages. Nothing in these Terms limits liability that cannot be excluded under applicable law.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above; continued use of the Service after a change constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of Kenya, without regard to conflict-of-law principles.
